Police custody is generally given when the magistrate is satisfied that the same is necessary in furtherance of the investigation. Thereafter, accused is sent into judicial custody. In judicial custody, the individual in question is held up in the jail that is in turn run by the state prison authority. Under judicial custody, investigating officer does not have an access to the accused. This approach is adopted to ensure that accused is not tortured.
